Criminal Law

Clear answers for serious situations.

A: Yes. Innocent people get charged every day, and prosecutors do not dismiss cases simply because someone says they didn’t do it. An attorney protects your rights, challenges the evidence, negotiates with the prosecutor, and ensures you don’t accidentally hurt your case by speaking to police or appearing in court unrepresented.
A: At your arraignment, the judge informs you of the charges, your rights, and asks how you want to proceed. No evidence is presented at this stage. In most cases, your lawyer can appear for you, enter a plea, and begin negotiations with the prosecutor while protecting you from saying anything that could harm your defense.

A: Not necessarily. Jail is NOT automatic. Many cases can be resolved with:
• Dismissals
• Reduced charges
• SIS / probation
• Diversion programs
• Fines or classes instead of jail

Your criminal history, the evidence, and the county you’re in all play a role — but an experienced attorney can often avoid jail time, even in serious cases.

A: No. You should never talk to law enforcement, detectives, or prosecutors without an attorney present. Anything you say — even casually — can be used against you, taken out of context, or used to strengthen the case against you. Politely say: “I choose to remain silent and I want a lawyer.”
